Terms & Conditions

"The Company" means Subzero Logistics Sdn. Bhd. (1535787-A) and THS Warehousing Sdn. Bhd., jointly and severally, including their servants, agents and appointed subcontractors.

"Customer" means the party registering an account, placing a booking, or on whose behalf a booking is placed.

"Portal" means this website and any booking, tracking or payment service offered through it.

The Company provides LCL (less-than-container-load) consolidation services for frozen, chilled, ambient and other approved cargo, port-to-port or door-to-door as booked.

All carriage is subject to the terms of the Company's House Bill of Lading, which govern in the event of any inconsistency with these terms.

A booking request placed on the Portal is an offer only. No contract exists until the Company reviews and confirms the booking with a booking confirmation (BC) number.

The Company may accept, reject, offload or roll over any shipment at its discretion, including for space, compliance, or inaccurate declaration reasons.

Bookings are subject to the published cut-off. Cargo tendered after cut-off may be rolled to the next available sailing.

The rate shown at the time of booking is honored for that booking, subject to the declared particulars being accurate.

Chargeable volume is the actual measured CBM or volumetric weight, whichever is higher, with a minimum of 1 m³ per shipment. Quantities, weights and measurements verified at the Company's warehouse are final and supersede declared figures.

Invoices are payable in full by their due date. The Company reserves the right to exercise a lien over cargo and documents for unpaid amounts, and to charge for storage, demurrage and detention arising from late payment or late collection.

Promotional rates apply only to the specific sailing and cut-off advertised.

Only HALAL-certified goods are accepted on the Company's cold-chain consolidation services. Non-HALAL goods are strictly prohibited.

Dangerous goods, contraband, currency, live animals, and cargo prohibited by Malaysian law or the law of the destination are not accepted.

The Customer warrants that all particulars (description, quantity, weight, dimensions, temperature requirement) are complete and accurate. Costs or penalties arising from non-compliance or inaccurate declaration are for the Customer's account.

The Customer is responsible for adequate export packing and clear marking of every package.

The Customer must declare the correct temperature requirement (Frozen / Chilled / Ambient). The Company is not liable for deterioration of cargo tendered at the wrong temperature or in packing unsuitable for the declared temperature.

Vessel schedules, ETDs and ETAs shown on the Portal are estimates and subject to change by the carriers without notice. They are not guaranteed.

The Company may substitute vessels, reroute, transship, or divert cargo to an alternative sailing where reasonably necessary.

The Company's liability for loss of or damage to cargo is limited in accordance with the House Bill of Lading terms and applicable international conventions, and in no case exceeds the lower of the actual cargo value or the limits stated therein.

The Company is not liable for indirect or consequential loss, including loss of profit or market.

Cargo is not insured unless expressly arranged in writing. Customers are responsible for their own cargo insurance; the Company can facilitate insurance upon request.

The Company is not liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, weather, epidemics, strikes, port congestion or closure, government action or restrictions.

The Customer is responsible for the confidentiality of its Portal login and for all bookings placed under its account.

Information provided during registration and booking is used to perform the services, meet legal obligations, and communicate service notices. Shipment data on the Portal is provided for the authorized customer's own use only.

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction.

The Company may update these terms from time to time; the version published on the Portal at the time of booking applies to that booking.

If any clause is held invalid, the remaining clauses continue in full force.
